Overview

An allegation of abuse made by a patient against a care team member can be frightening, unsettling and disruptive for the person making the allegation, the care team member, and the organization. In addition, such an allegation of abuse can create the perfect storm resulting in a regulatory finding, criminal actions and possibly a civil suit.

This presentation will discuss the key elements of a prevention plan, review how to best provide for an organizational response should an allegation occur and discuss the insurance implications for such an incident.

At the end of the webinar, the participant should be able to:

  1. Identify clear steps that ensure for a thorough and credible investigation if an allegation of abuse is made against staff or providers by a patient or a family member.
  2. Describe the legal reasons to report inappropriate interaction, abuse, and neglect by staff members.
  3. Evaluate areas where implicit bias can influence identifying, investigating and responding to allegations of abuse.

Provider approved by the California Board of Registered Nursing, Provider number 12205 for 1 contact hours.

This meeting has been submitted for approval for 1 contact hour of Continuing Education Credit toward fulfillment of the requirements of ASHRM designations of FASHRM (Fellow) and DFASHRM (Distinguished Fellow) and towards CPHRM renewal.

Faculty

Joan Porcaro, RN, BSN, MM, CPHRM. Joan has over 30 years of extensive experience as a health system risk management and patient relations professional. Prior to her work in risk management, she served as an operational leader in acute care, home health, hospice, and physician practice settings. In 2022, Joan joined WTW as  the Director of Client Relationship Management where she provides support and resources to healthcare clients to assist them in better managing and reducing their risks.

Joan has served on several committees as a leader and member for ASHRM and has served as an ASHRM state chapter board member.

Maryann McGiveny. Maryann is currently serving as the North American Healthcare & Life Sciences Vertical Leader for WTW where she identifies new risks as well as trends in risks, develops tools and resources to assist clients in managing and mitigating those risks, and sets the strategic direction for WTW’s healthcare and life sciences industry vertical. She has 30+ years of experience working with healthcare clients and insurance products.

Maryann is a frequent speaker at national and local risk insurance events. Previously, she was named as one of the “Elite Women” in Insurance Business America magazine.
